delivery to customers all over Great Britain and always return to base by train. Is the time spent travelling on the train to be counted in my working hours for the day and the week?

AThe point that you have raised is a difficult

one to answer because this is one of those aspects of the Drivers' Hours Regulations which is very much dependent on a court case to establish a definite interpretation of the particular regulation. We, however, take the view that while you may not appear to be under the instructions of your employer while actually travelling on the train nevertheless it is part of your duty to return to base ready to collect the next vehicle, so you may be considered to be on duty during this time. Your time spent travelling, therefore, must be included in your daily and weekly working hours.
