AT West Hartlepool County Court last week Judge C. Cohens said that the local corporation should have sent a refuse collector back to the makers, because its cost increased by £125 10s. between order and delivery.
The corporation, he said, had no defence to an action brought against it for this sum by J. Johnson and Son, Victoria Gar'age, West Hartlepool, who supplied the vehicle, because time was not an essence of the contract. He gave judgment for Johnsons, with costs, adding that he thought that the makers were much to blame. The vehicle had been ordered on July 7, 1955, and not delivered until March, 1956.
