WARWICKSHIRE POLICE are coming under attack for failing to prosecute a German truck driver who was involved in a road accident last month — they claim the case lies outside theirjurisdiction.

Richard Barnes ,of Birmingham Truck Centre, says he is astounded by the police's failure to act after the accident which involved his father Frederick and a German truck on a rural road near Weston on Avon on 16 May.

"My father was driving a Land Rover when he spotted a truck coming the opposite way," he says. "He stopped and moved to the side of the road.

-The truck kept coming and tried to squeeze through a gap which was not wide enough," Barnes adds. "It hit the Land Rover which went three to four feet up in the air. My father was taken to hospital with whiplash."

Barnes reports that police breathalysed the truck driver and "took his details before letting him go". A letter from Warwickshire Police on 2 June confirmed that"as the other driver was a German national we have no jurisdiction with relation to any court proceedings in this matter".

Barnes is furious with the decision: If a British driver did that in Germany they would lock him up. It should be fair's fair in my view. It's not right."
