THE TRANSPORT Tribunal has directed the South Eastern & Metropolitan Traffic Commissioner to reconsider a decision to revoke the licence held by KPG Site Services after it was claimed that the company had tried to surrender its licence.

In June and September 2(X)4 KPG director Michael McCann had written to the Traffic Area Office saying he wished to surrender the licence as the company had ceased trading and the vehicles had been taken away by his co-shareholder in the business. He wanted to dissolve the company but his co-shareholder would not agree. Following a number of phone calls to the TAO, McCann applied to surrender the licence on 10 January.The application was received on 14 January, but the licence was revoked on 3 February.

Appearing before the Tribunal, McCann said the company had also held a licence in the Eastern Traffic Area, which had accepted its surrender and sent him a refund for the unused portion.

He appreciated he should have applied to surrender the South Eastern licence earlier than January but he had telephoned the Traffic Area more than once and its staff must have known about his plans.

Asked how he had managed to return the licence discs if the vehicles had been taken by his co-shareholder. McCann said he had simply gone to where they were parked and taken the discs. He added that when his co-shareholder had taken the vehicles away he had tried to get the police to help but they had said a dispute between shareholders was a civil matter.
