IWA-WI of tachograph records by one of his drivers has had his fleet

put off the road for two weeks.

The North Eastern Traffic Commissioner Tom Macartney revoked the licence held by Brian Smith and Shelley Mawson, trading as Brian Smith (Goole) Pallets and Light Haulage.

However, he granted an application for a fresh licence for five vehicles by Smith alone, which comes into effect 14 days after the date of the joint revocation.

Traffic examiner Roy Harrison said that following an examination of tachograph charts for the period between May and October 2000, three drivers were prosecuted at Hull Crown Court for 22 offences of falsifying tachograph charts, with a further 36 taken into account. Two drivers were given the maximum of 240 hours of community service, with 2400 costs, and the third was fined 2525, with 275 costs. A fourth driver, Stephen Taylor, who appeared to have committed 15 offences of falsification, had so far not been traced.

Smith subsequently pleaded guilty before Goole Magistrates to an offence c falsifying a tachograph chart and was fine 21,000 with 275 costs. A driver had drive 824km in a day, using two charts in order ti get the vehicle back so that it was availabt for a booking the following day, and Smitl had entered his name on the second charl

In addition, there were 140 minor cen trefield and drivers' hours offences Smith told the TC that his CPC holder he left some time ago and he admitted runnin the operation on his own without qualified transport manager. Smith alsi claimed that he was out driving on the row at the time of the offences.

Smith argued that although he was sti employing the three convicted drivers the had received training about the drivers hours and tachograph rules and the vehi cies now had devices in the cab which kep track of the hours driven and the rest taken

Outlining the procedures now in place current transport manager James Heale said that on his first day he gave all the dri vers a verbal warning.

Smith undertook to take the CPC exami nation himself and to have a 100% analysis o his tachograph charts.
