• Although two Midland owner-opera tors had gone to some length to prove the would keep maintenance records if grante 0 licences neither of them, in fact, did kee records once the licences were granted. A a result both the operators, Mr S. J Hewitt of Coventry and Mr M. Smith o Bilsdon, were called before the Wes Midland LA, Mr John Else, under Sectio 69 in Birmingham on Tuesday.

The court heard that Mr Hewitt originally licensed to operate one vehicle had been granted a temporary substitution on his licence while his own vehicle was being repaired. Mr Hewitt was visited by a DoE vehicle examiner on February 3 this year who found that no records at all, other than one invoice, were being kept.

The LA said that at a public inquiry on September 27 1971 Mr Hewitt had stated that if granted a licence his vehicle would be maintained by a local garage and record sheets would be kept.

However, Mr Hewitt was not using thi: garage and no records were being kept al all.

Asked why, Mr Hewitt replied that aftei paying £80 to have his vehicle serviced i had still failed its annual test and for thh reason he had decided to maintain ant inspect the vehicle himself with the aid of k colleague.

He had not kept any records up to till examiner's visit because he had not beet able to obtain any forms but since then h, had bought a supply from the RHA.

On reaching his decision Mr Else sai4 that he would remove the authority for th, substituted vehicle for a period of at leas two weeks or up to the time that M Hewitt's own vehicle was repaired. In th case of Mr M. Smith it was said that whe: the application was made a record form o the type to be used had been sent to the LA A vehicle examiner's inspection on Marc 24, however, revealed that these record had not been kept. Mr Smith told the Li that he had not been able to obtain an record forms at all and asked the LA if h knew where they could be purchased. Th LA replied that since Mr Smith had ot

tamed one which he enclosed with h application he should be able to obtain further supply and added: "If you coul produce a form to 'con' me into grantin the licence you can get them now".

The LA decided to curtail the licence t removing the margin of one vehicle and further suspend the one vehicle in posse sion until acceptable maintenance forn had been produced,
