Which of the following most accurately describes the problem?

DRIVER AGENCY ADR Network of Luton has gone beyond the scope of the new Agency Worker Regulations by offering permanent contracts to all its HGV drivers.

As of 1 October, agency workers are entitled to the same beneits as employees after 12 weeks’ employment. However, ADR has gone a step further by offering its drivers employee status, guaranteeing a 37.5-hour week averaged over a 13-week period.

The new regulations state that agency workers who have passed the qualifying period have equal rights to pay, holidays, overtime pay and bonuses. Length of the working day and rest breaks, among others, must all be equivalent to their employed colleagues. “We are also offering injury insurance and unlimited rest days,” says
