A LINCOLNSHIRE independent, Enterprise and Silver Dawn, must wait indefinitely for authority to increase its operator's licence from two to four vehicles.

Doubts about the outcome of a planning appeal led the Eastern Traffic Commissioners to adjourn the application by the company when they also considered taking action against the existing licence on the ground of maintenance and finance.

Evidence was given that proprietor Michael Gallagher had an inspection pit at his premises at Waddington but no covered workshop accommodation.

The vehicle examiner was satisfied about the maintenance of the existing vehicles after it was agreed that they would be inspected by a freelance fitter, using Mr Gallagher's facilities, and a commercial garage.

Ian Rothera, for Mr Gallagher, said it was proposed to construct a workshop suitable for two double-deckers. However, a decision refusing planning permission for the number of vehicles it was proposed to , operate had been appealed and there was no point in seeking planning permission for the garage facilities until the outcome of that appeal was known.

Commissioners' chairman Kenneth Peter said a letter from Mr Gallagher's accountants gave the assessable profit for the year ended April 1983 at £7,290 (1982: £2,809).

The business was financed by bank borrowing and coaches were bought outright. The loan was secured on a grandparent's property which Mr Gallagher would eventually inherit. It was not prudent for the grandparent to become a partner because of capital transfer tax problems.

The Commissioners had conciJded that they need not take action against the licence: they were satisfied on finance; and they had assurances that the maintenance of two vehicles would be backed up by a commercial garage.

However, concerning the additional vehicles, they wished to make no decisions that would prejudice matters else where. They adjourned considerations of the additional vehicles sine die.
