However, West Midland Traffic Commissioner David Dixon imposed conditions that vehicles could move only between 06:00-20:00hrs on weekdays, with no movements before 08:00hrs at weekends. He also specified the route to be used by vehicles leaving the site.

The firm had been operating two vehicles and one trailer from Ross under interim authority.

The residents expressed concern about further expan sion of the business bringing more traffic past their houses. They believed that noise from the yard would extend into the night, and were worried about dangers to pedestrians caused by HGVs using narrow country lanes.

Sean Mason, a partner, maintained that it was easier to manoeuvre an artic through the lanes than a rigid. He said that operations generally finished at 18:00hrs during the week, but added that they could go on to 20:00hrs if a truck was delayed.

On Saturdays vehicles only left the yard for maintenance, he added. They might return on a Sunday depending on the amount of work to be done on them. The vehIcles were main

tained by a commercial garage in Hereford and no maintenance took place at the site.

Granting the licence, the TC instructed the firm to give written instructions to its drivers not to exceed 30mph when driving through the lanes. He also asked it to erect concrete bollards to protect the walls of adjacent properties.

Imposing the time conditions, the TC said residents living near the site had a right to quiet enjoyment of their homes.
