Graham Alfred Fulcher, of Stockport, was convicted of theft after the trailer was removed from the Carcroft Industrial Estate, Doncaster in September 1996.

The court heard that Fulcher claimed he was "several thousand pounds out of pocket' as he had not been paid for past work. The trailer contained 23 tonnes of aluminium plates with a value of £41,000. Lawyers for Fulcher described the 18-month sentence imposed at Bradford Crown Court last November as "manifestly excessive".

And Mr Justice McKinnon, sitting with Lord Justice Rose and Mr Justice Collins, said: It was not necessary to pass a sentence as long as 18 months." He took into account Fulcher's "deteriorating health"; Fulcher is also BO% deaf, "This was very much a one-off offence, arising out of the appellant's justified grievance against his 'employers'," McKinnon added.
