Which of the following most accurately describes the problem?

AN application for six artics (refrigerated vans) on A licence. with the normal user" Meat and other refrigerated food within 200 miles ", subsequently amended by mutual consent between the applicant and objectors to four vehicles with the normal user " Meat and other refrigerated foods into and out of Fairfield Cold Stores Ltd. within 200 miles ". was granted to Refrigerated Transport Ltd., of Bow, London, E.13, last week by the Metropolitan deputy Licensing Authority. The grant was subject to the surrender of

C and C-hiring licences held by Fairfield Cold Stores Ltd, and Fairfield Haulage Ltd., who had four tractors and seven trailers between them. Refrigerated Transport is a recently formed associate company.

In evidence, Mr. A. P. Reader, a director of the three companies, admitted that about 5 Per cent of the work done by the C-licensed vehicles was for hire and reward. When Mr. C. J. Macdonald, the deputy Authority, asked "You must have known this was wrong ", Mr. Reader said this work had to be done to keep customers.

Mr. G. A. Howard, administrative director of the three companies, said that insulated vans were used for, the work of carrying meat, but it was now desired to use refrigerated vehicles, which were more modern and efficient. When asked by Mr. Macdonald if he knew that a certain amount of hire-and-reward work had been done by Refrigerated Transport he replied, "Yes. We have been let down by other hauliers".

In making the grant as amended, Mr. Macdonald sought an assurance that only goods into and out of Fairfield Cold Stores would be carried and asked that Refrigerated Transport should keep records available for inspection of any work done outside the declared user.
