A. WEST MIDLANDS operator who claimed not .o have used his vehicles since his licence lapsed last filly has been asked to produce invoices to explain various payments into his bank account during October and November.

Coleshill-based Lawrence Lockhart had allowed his sole-trader licence to lapse and was seeking a new six-vehicle licence in the name of a limited company he had formed, LE Lockhart (Haulage).

David Dixon. Traffic Commissioner for the West Midlands and Wales, said he had received a report from Warwickshire police about an empty Lockhart vehicle that had been stopped in August and was not displaying a valid 0-licence disc.

Lockhart claimed the driver had been doing him a favour. His previous licence had been terminated when he had failed to pay the renewal fee due to an oversight. He had been ill at the time and the vehicles had been parked up since June.

After financial evidence was heard in private, the IC said he questioned whether the vehicles had been used since the previous licence came to an end.

The police report raised a question in his mind, as did the bank statements showing money going into the account. He had been told that was due to money coming in from jobs done before the licence terminated and from drivers doing -bits and bobs" but he needed to see the invoices relating to those receipts, which would clarify whether the work had involved using the vehicles.TheTC reserved his decision pending the production of the invoices; he will announce it in writing at a later date.
