Eight of the firm's drivers tdmitted various offences of alsifying tachograph charts, tiding and abetting Petty to fal sify charts, failingto keep tachograph records and taking insufficient rest and breaks. They were tined between ,€.100 and £900 and were each ordered to pay 2170 costs.

For Petty, Stephen Kirkbright said this was a long established business run by the Petty family for 30 years. Until September of last year it had principally been a five-day operation.

In September Petty was asked by Maersk Line, a major customer, to handle work for Hays International Distribution. That work involved a seven-day operation. He asked if the number of weekends could be cut. Maersk initially agreed but when another operator pulled out insisted that Petty's had to do the weekend work.

The firm had a perfect record before these of the offences and since, said Kirk bright. The offences had all been committed during a short period when Petty was under pressure. The Hays work stopped last Christmas.

Petty promised that the firm would continue to have its tachograph records professionally analysed and that the drivers would be put through an annual training course. For the drivers, David Chant said the offences had not been committed out of greed but simply to make ends meet. Long periods were spent waiting atthe Hays depot.

Adjourning the proceedings, the TC said he would want a check to be made on the firm's tachograph records before the hearing resumed to ensure that its drivers were complying strictly with the regulations.
