Which of the following most accurately describes the problem?

• The Transport Tribunal has issued two written decisions this week; in both cases judgment is in favour of THC (BRS Ltd.) In the first case THC was appealing against a decision of the Yorkshire LA (CM Nov 22) who had granted Textile Deliveries Ltd. a variation in its normal user and the addition of one vehicle not exceeding 5 tons. At the hearing Mr. R. N. Yorke, for the appellants, had said that this was an appeal on principle.

At the public inquiry Textile Deliveries Ltd. had made out a prima facie case for the extension of radius to carry carpets, stationery, and printed matter for two named customers. However the Tribunal took the view that the company had failed to show any increase in earnings since September 1967. The grant was amended to exclude the addition of the 5-ton vehicle.

In the second case, where THC appeared as respondents, Chris Metcalfe Ltd. had applied to vary its A licence by the addition of one vehicle. (CM Nov 29) In this case Mr. G. P. Crowe, for Metcalfe, said that the Yorkshire DLA had misdirected himself.

It was contended by Metcalfes that the additional vehicle was required to meet an increase in demand for London dock traffic which had been created due to dock delays.

The Transport Tribunal agreed with the DLA that no case had been made out for additional long-distance facilities. It expressed the opinion that any relief sought in that connection could be met by varying the company's B licence to add one vehicle for its collection and delivery service.
