THE REVOCATION of the 0-licence held by Woking-based horse trader Felix Connors by the South-Eastern & Metropolitan Traffic Commissioner, Philip Brown, has been upheld by the Transport Tribunal on appeal.

Connors failed to attend before the TC, who was informed that a vehicle examiner had tried to carry out a maintenance investigation, despite a number of attempts to contact Connors. Before the Tribunal, Connors said he had not received any letters apart from the decision letter. He was a traveller and was away from the operating centre for six months of the year. There was only one postbox for all the families who were living on the site, and correspondence did go missing.

The person responsible for the maintenance of his vehicle had offered to receive and deal with his correspondence, which would help because he could not read.

In obtaining an 0-licence, he had been endeavouring to "run legal" and he was frustrated by his position. Connors hoped that the Tribunal would reinstate his licence because of the cost and time in applying for a new one.

The Tribunal said that although it sympathised with Connors' position, it could not find that the TC's decision was plainly wrong against the background of a complete breakdown in communication.

They were hopeful that if Connors devised systems to ensure that correspondence was dealt with in the future, and that he complied with all the other requirements for obtaining an 0-licence. any new application for a licence by him would be granted.
