Before the decision Waterlouse managing director Ted Naterhouse had threatened to :ake his case to the High -ourt.

In their written decision on :he case the Traffic Commissioners said they were not satisfied that there was any public need for additional iervices other than those )rovided by Southdown from :he centre of Eastbourne. They vvere prepared to authorise the service from Polegate only because of the large proportion of elderly people resident there who would have difficulty travelling to Eastbourne.

Waterhouse already operated a large number of private hire excursions from the Eastbourne area and the Traffic Commissioners' decision pointed out they will still be free to do so. The Commissioners were not convinced that Waterhouse could charge similar fares for licensed trips that they do for private hires.

"Some degree of competition is desirable in the leisure field," said the Commissioners. "In this particular case there is some evidence that there is an untapped market, probably local in character." • In a decision issued at the same time Southdown were let off by the Commissioners for running some unauthorised tours from the area. They stated that they were convinced that Southdown had no "intention to operate otherwise than in accordance with the conditions of the licence as they then existed, on a bona fide (albeit arguably too wide) interpretation of those conditions."

Where the Southdown tours offered were on the same route as any other NBC company, the Commissioners granted permission for the tours to be linked at any authorised picking-up point on the line of route.
