Which of the following most accurately describes the problem?

IF A company did not employ a full-time transport manager, Licensing Authorities could not grant an Operator's license, northwestern LA Roy Hutchings has ruled.

G. Calamita of Chadderton, applied for an 0-licence at Manchester and named J. A. Saxton as the qualified transport manager with an address in Halifax, but said he could not afford to pay a full-time manager's wages.

Questioned by the LA, Mr Calamita, who said his knowledge of English was limited, agreed that Mr Saxton was connected with J. Saxton and Sons of West End Garage, Huddersfield. There was no formal contract of employment and Mr Saxton had failed twice in his attempts to obtain a Certificate of Professional Competence.

Asked what Mr Saxton's employment amounted to, Mr Calamita said he was engaged on "paperwork" and he did not believe he did anything else.

When Mr Hutchings said he was not satisfied about the ar rangements, Mr Calamita admitted he could not afford to pay a full-time salary.

The LA pointed out that he had no option but to refuse the licence application unless a formal contract of employment could be produced, indicating the exact nature of Mr Saxton's work.

If the matter had come before him earlier, said Mr Hutchings, he would not have granted an interim licence in the first place.
