A RECYCLING FIRM and truck giant Volvo are squaring up for a court showdown following an accident that left a truck driver with a permanent disability.
The legal action stems from an accident in September 2003 in which a truck operated by Midlands firm Fortress Recycling collided with a stationary truck.
The driver of the second truck was left with a permanent disability that means he can no longer drive; Fortress's vehicle was written off.
Fortress claims that Volvo engineers who had serviced its truck the previous day had failed to check its brakes properly.
A police investigation following the accident determined that one of the brakes on the middle axle had overshot its legal limit.
Fortress was cleared of any wrongdoing at a public inquiry after Vosa had thoroughly checked its documentation.
Despite this, its insurance company only agreed to pay out to the third party, leaving Fortress short of a E40,(X)0 truck.
It is currently suing Volvo for the cost of a replacement vehicle: however,no date has yet been set for the trial.
Volvo declined to comment.
