A STOCKPORT MAN has lost his bid to reclaim a truck that was impounded last October in Birkenhead. He claimed he had been told it was covered by the 0-licence of a firm he was working for.

Stephen Doherty, of Lime Street, Stockport, appeared before North Western Deputy Traffic Commissioner Patrick Mulvenna at a Macclesfield public inquiry.

Refusing to return the vehicle, the Deputy TC said Doherty and his brother Darren had bought it from Gerald McKenna in September.The road tax had expired at the end of August and the vehicle was displaying an 0-licence disc for another vehicle.

Neither of the Doherty brothers had looked into either of these questions, he added Instead the vehicle had been operated without an 0licence, valid tax disc or tachograph chart. That was why it had been impounded.

Doherty had claimed he did not know the vehicle was being used illegally, but Mulvenna said he could not accept that. It was clear that Doherty knew of the licensing system and had considered the position Doherty claimed he had been told the vehicle was specified on the margin of another licence but he hac neglected to check if this was true and had "carried or regardless".

The DTC said his view of Doherty's actions was confirmed by the same neglectful and irresponsible attitude shown over the road tax and the tacho charts He concluded that Doherty had chosen to ignore al those aspects and take a chance.
