PUNITIVE TOLLS levied on Austria's trans-Alpine Brenner motorway have been undermined by a European Court of Justice (ECJ) ruling, which will allow hauliers to claim compensation.

The decision sets a precedent across the EU: it could be used to challenge other tolls designed to dissuade hauliers from using environmentally sensitive routes.

The ECJ supported Austrian haulage company Rieser Internationale Transporte in its campaign to recoup tolls. which were especially high between 1997 and 2000 for trucks travelling the entire motorway. Drivers using sections of the road were charged far less.
