31/ DRIVER William Guild who was dismissed by Mac Mix Ltd of affen Street, Motherwell from its Dalkeith depot has been warded £2712.50 on a successful claim for unfair dismissal.

Employed from January 1977 August 14,1981 he was one of company's three drivers. The ilkeith depot had been relired to dismiss one driver and iild was selected and paid full rtutory redundancy.

The company operated redunncy on the basis of laying up 3 oldest vehicle and that dic

tated immediately which driver should be dismissed.

Mr Guild was the longest serving driver at the depot where his vehicle was the oldest.

The Tribunal ruled that Guild was not selected as an individual but by his relationship to his vehicle and that the company failed entirely to appreciate the need to select individuals.

Its approach amounted to little more than a lottery. The longest serving driver who had retained his vehicle throughout would be the first to go. If a vehicle had happened to be replaced in the year before redundancy the driver would be retained.

They could not find that the method of selection was at all fair.

The Tribunal ruled that it would take some time for the applicant to obtain comparable employment and awarded an amount for his losses to date and onward for five or six months.
