A Scottish court has overruled the Transport Tribunal and put

unlicensed trucks back on the road. Chris Tindall reports.

TWO DURHAM-based operators who turned to the Scottish legal system to appeal against the revocation of their 0-licences have won a suspension of TC Tom Macartney's decision.

The ground-breaking ruling means Pallas Transport and Montana Freight Services can continue to run without 0-licences until another hearing in Scotland's Court of Session — and this could be 12 months away Police, Customs & Excise and VOSA officials carried out a dawn raid on the two companies, which trade from the same premises, in February 2003. Five trucks belonging to the two firms were impounded after C&E claimed significant amounts of paraffin were discovered in some of the vehicles' fuel tanks.

Both Pallas Transport and Montana Freight Services subsequently had their licences revoked by Macartney, who found they had lost their repute (CM 1 January). An appeal against this decision to the Transport Tribunal was dismissed in June.
