A TRUCK DRIVER who killed a family of four in a motorway crash has been acquitted of causing death by dangerous driving.

Instead a jury at Luton Crown Court found William Ishani of Swindon guilty of four counts of careless driving. He was fined £1,000 and banned from driving for a year.

The court heard that Ishani's 38-tonne truck ploughed into the back of a car, shunting it under the wheels of another truck, after he failed to see a queue of waiting traffic. Murtuza Khambaty, his wife Tasneem and their children Sakina and Hussain were killed instantly in the crash on the M1 near Toddington on 5 June 2003.

The prosecution suggested Ishani had fallen asleep at the wheel; he denied this. Ishani, who had worked on night shifts for Wincanton for five years,said that he had had plenty of sleep before going to work and had napped during a break at a motorway service area. Judge Geoffrey Been said: "In the circumstances, the penalty impose will, I'm quite sure, be considered derisory by some. But it is the penalty which is appropriate for the offence."

• A Romanian truck driver has been jailed for 18 months after he drove the wrong way down the road and crashed into a van, killing the driver.

Ilberir Mastan denied causing the death of Lester Colley by dangerous driving but was convicted by jury at Shrewsbury Crown Court. The court heard that Mastan had been driving along the A442 in Stockton on 2 November 2002 when he came to a curve in the road. He because confused and went onto the wrong side of the road, ploughing into the van.

He was also banned from driving for three years and ordered to take an extended driving test.
