Stephen Harvey has now been iwarded a total of £9.947 since 002, all against the national egg ielivery firm Stonegate Farmers, vhich closed its depot at Seisdon, tearWolverhampton in December !004.The company has since been nerged with Deans Foods to form ioble Foods.

But Harvey failed to persuade Birmingham Employment Tribunal to make his former employers pay for him to be retrained for a haulage desk job such as a transport manager.

He says: "I wanted my former employers to pay for my retraining to save the tax payers footing the bill. The Tribunal refused my application and it now means the government using tax payers' money will have to retrain me for a desk job.

-Because of my spine trouble, I'm no longer fit enough to drive lorries."

Harvey was awarded £6,397 at the latest hearing after successfully claiming that Stonegate failed to make reasonable adjustments in finding him an alternative job to driving after he returned to work in April 2002 following medical treatment. The award includes £3,500 for injury to his feelings.

Harvey fractured his spine in October 2001 after complaining that worn-out industrial shoes caused him to slip and fall between his cab and the truck. After six months' treatment he returned to work expecting to be put on light duties.

He was subsequently dismissed following a dispute and was awarded £2,800 at a Birmingham Employment Tribunal for unfair dismissal.

Another Tribunal hearing awarded him £750 for losing his position as the firm's health and safety rep.
