THE West Midland Licensing Authority, Mr. W. P. James, told British Road Services, Ltd., that he was not prepared to grant a normal user for vehicles that had been operated under a special-A licence which was wider than justified by the evidence. He said this at Birmingham, on Tuesday, when 12 West Midland depots sought replacements of time-expired vehicles.

The Cheapside depot, at Birmingham, sought eight Leylands and Albions to replace worn-out lorries, which were engaged with the remainder of the authorized vehicles as a directional unit for the south eastern areas and the Home Counties. Mr. James pointed out that the normal user "General Goods, Great Britain mainly south eastern area and the Home Counties" was too wide as traffic for other areas was transferred to other units.

He was also concerned about three vehicles engaged in collection and delivery within 20 miles over the past 12 months.

Mr. J. C. Pearson, depot superintendent, said the vehicles had been kept on local work because they were worn out. This had meant a reduction in the Luton trunk service from 10 vehicles to eight nightly, and the use of sub-contracting, which had brought complaints from some of their customers including Vauxhall Motors, Ltd.

Mr. James adjourned the application for evidence that customers had been put to a disadvantage by the change. A normal user excluding the words "Great Britain" was accepted. Although there were no objections to the applications, Mr. James made it clear that the same onus of proof for a wide normal usei would be required from the British Transport Commission, as from any other operator.
