A CUMBRIAN OPERATOR who ran a limited company from an unauthorised operating centre for four months has been given a second chance to prove he can operate within the law, even though a Deputy Traffic Commissioner described the way he had run the business as a "total shambles", North-Western Deputy TC Patrick Mulvenna was considering action against the two-vehicle restricted licence held by Wigton-based Jason Penrice, together with an application for a new two-vehicle licence by a company called Tank Replacement which listed Penrice as the sole director.

Penrice said he had started on a small scale. As the business grew he acquired a 7.5-tonner. He formed a limited company in November or December and subsequently moved to a larger, more secure site at Firtree Bank. The 7.5-tormer had been sold at the end of March and he had recently acquired a larger vehicle equipped with a crane. He agreed that the new vehicle was being operated from Firtree Bank, even though a vehicle examiner had warned him that he was nol authorised to operate from there.

Asked what arrangements he had made to ensure that his vehicles were operated within the lavv, Penrice replied:-None."

The Deputy IC said the truth was that there had been almost total non-compliance with all the licence undertakings since 2005, generally with no excuse. Penrice admitted it had been "a steep learning curve".

Revoking the existing licence but granting the company's application for a new licence, the DTC asked Vosa to check up on the operation without notice within the next 12 months.
