Which of the following most accurately describes the problem?

A LEEDS owner-driver has been banned indefinitely from holding an 0-licence after failing to appear at a public inquiry to answer for a string of offences. These included maintenance problems, the use of an unauthorised operating centre and the use of hired vehicles without licence authority.

James Harrison, trading as Action Couriers, of Leeds, had been called before North Eastern Traffic Commissioner Tom Macartney. but failed to appear. The TC held that Harrison's transport manager Kevin Gill, who did appear, had lost his repute as a transport manager.

Senior vehicle examiner Mark Millard detailed prohibition notices imposed on Harrison's vehicle. He said the vehicle was involved in a road traffic accident in October 2003.A subsequent maintenance investigation revealed an inadequate driver defect reporting system, and no defect records could be produced.The stated inspection frequency of six weeks had been extended to seven, eight and nine weeks.

No inspection records were available from 3 July 2003 as they were with the maintenance contractor due to money being owed for work.

The TC was told that vehicles were regularly being parked at Londesboro Terrace, which was not authorised as an operating centre; that hired vehicles had been used without licence authority on two occasions; and that Harrison had failed to respond to letters.

Gill claimed he had been unaware that safety inspection intervals had been exceeded on several occasions in 2003. He was unaware that the only vehicle specified had been involved in an accident requiring major repairs. Gill claimed to have been analysing the tachograph charts on a weekly basis and said he was unaware of hired vehicles being used or the use of an unauthorised operating centre.
