Which of the following most accurately describes the problem?

• Four drivers who had been paying their own tax have this week been given the go-ahead by an industrial tribunal to claim redundancy from their employer.

The four successfully argued at the tribunal in Southampton that they were employed by Southampton-based J&W Tipper Hire, although the company had said because the drivers paid their own tax they could. not officially be employed. The victory means the drivers can expect to divide between them a redundancy payment of around £8,000. It also leaves open the prospect of another hearing in January when the drivers will argue they were unfairly selected for dismissal.

Peter Doughty, barrister for the four, says: "The fact that the company owned the vehicles was an important factor." They had also been recognised as employed for National Insurance purposes.

The drivers said they worked for J&W full-time and were paid for holidays. They also argued long service: one of the drivers, Richard Swaffield, had worked for the company for more than 10 years.
