• An owner-driver who moved his operating centre after a dispute with his landlord was called to a public inquiry before North Western LA Martin Albu, when he applied to renew his national licence for two vehicles and two trailers.

The LA was considering disciplinary action against the licence held by John Clare, trading as JT Clare Transport Clare said that he had one vehicle and one trailer in possession. His original operating centre was in Macclesfield: he left that site after a dispute with the owner and the vehicle was then parked on an industrial estate in Stockport. Clare conceded he had not notified the move to the LA.

He was told by a vehicle examiner that he could not use that site as it was not off the road and asked a security guard about using a nearby industrial unit. He was told to see a man in a Land Rover, who gave him a letter of authority, which he submitted to the Traffic Area Office with his renewal application. He later discovered that the company whose letter heading the letter had been typed on had left the site two years ago. He had now obtained authority to park the vehicle at a site in Chinley.

Albu was concerned that Clare had submitted a letter that turned out to be false; however, he accepted that that had been a mistake. He renewed the licence without taking any disciplinary action, but warned Clare to keep the Traffic Area informed of any changes that affected his licence.
