Which of the following most accurately describes the problem?

In Wakefield, one of the delegates raised the question of whose 0-licence is at risk when you are running with third-party trailers. Both the IC and the Vosa representative Andy Thomas confirmed it was the responsibility of the operator pulling the trailer and the liability stopped there.

TO Tom McCartney said he had sympathy with operators caught in the situation where the driver had carried out the daily check on a trailer they were picking up and confirming it was defect-free, then taken it out, only for a problem to be found at a Vosa check. But he added that operators had to ensure trailers they were pulling had been properly maintained or run the risk of encountering problems.
