Which of the following most accurately describes the problem?

A SCRAP METAL operator has lost its appeal to the Transport Tribunal after its application for a licence was rejected because the local council opposed its operating centre.

The application from Huw's Scrap Metal Services, was refused by Welsh Traffic Commissioner Nick Jones, on the grounds that the specified operating centre was unsuitable. It had applied for a one-vehicle international licence based at Heel y Neuadd, Tumble, Llanelli. Carmarthenshire County Council considered the site to be unsuitable because of likely increased traffic levels, unsatisfactory exit and entrance arrangements and inadequate parking space. It claimed that the access road was under its control and permission was required before vehicle movements could be made.

Following a site visit, a traffic examiner concluded that the site was unsuitable in that the vehicle could not enter and leave in forward gear, it was too small and there would be an adverse environmental impact on neighbouring properties.

The application was refused after the firm declined an invitation to request a public inquiry.

Before the tribunal, Gary Walker, for the company, said that it had paid 0,000 to asphalt the access. A new gate had been installed by the county council and permission to use it had not been required. An earlier licence, which had authorised an artic twice the size of the proposed vehicle, had been allowed to lapse.

He claimed that the company had planning permission to use the site as an operating centre.

Dismissing the appeal, the tribunal said that the evidence before the TC was all one way and his decision could not be faulted.
