Which of the following most accurately describes the problem?

Tailboards are the sub lea of a recent inquiry. In particular the reader asks for the effect of recent amended regulations.

In the Motor Vehicles (Construction and Use) (Amendment) (No. 2) Regulations 1964, regulation 3 applies. In ascertaining the extreme projection points of a vehicle, account is to be taken of any device attached to the vehicle which increases the carrying capacity of the vehicle, unless (1) it is a tailboard which is let down whilst the vehicle is stationary in order to facilitate its loading or unloading, or (ii) it is a tailboard which is let down in order to facilitate the carriage of, but which is not essential for, the support of loads which are in themselves so long as to extend at least as far as the tailboard when in the upright position.

There is also the general requirement as contained in the Construction and Use Regulations 1963 that the weight, distribution, packing and adjustment of a load must at all times be such that no danger is caused, or likely to be caused, to any person on the vehicle or on the road.
