Which of the following most accurately describes the problem?

• Environmental conditions have been imposed on two operating centres which Express Group Food was taking over from subsidiaries Express Dairies and Northern Dairies (Western), following objections from Devon County Council.

The company had applied to add 11 operating centres — previously on licences held by subsidiary companies — to its own licence. The council opposed the application relating to dairies at Bideford, where three vehicles are based, and Barnstaple, where four are based. There were also representations from two local residents with regard to the Exeter dairy, where there is authority for 30 vehicles and 14 trailers.

The county maintained that Bideford and Barnstaple were unsuitable for the operation of large vehicles, but it was pointed out that the 38-tonne vehicles visiting those sites were based elsewhere. The residents maintained that the type of operation at Exeter had changed and complained particularly about noise nuisance.

In granting the application, Western Licensing Authority Major-General John Carpenter said the residents had failed to make their case and he imposed no restrictions over operations from Exeter. As far as Bideford and Barnstaple were concerned, he imposed conditions restricting the maximum size of vehicle to 16tonnes and requiring authorised vehicles to be part loaded and unloaded within the operating centre, entering and leaving in forward gear.
