Which of the following most accurately describes the problem?

• Almost 75 per cent of a fleet of 26 vehicles belonging to John N. S. Thomson, of Mossend, Lanarkshire, were found to be defective when checked by vehicle examiners in January. Mr P. Harper, one of the examiners, told the Scottish LA about the examination when the company had been called to appear at a public inquiry under Section 69.

It was stated that since the firm was granted an operator's licence last year there were eight immediate and 14 delayed prohibitions placed on vehicles, resulting from inspections or spot checks.

Describing the maintenance on the vehicles as "shocking", the LA, Mr A. B. Birnie, told Mr Ivor Thomson, the proprietor, to withdraw three vehicles from the fleet. In mitigation, Mr J. Law, for Mr Thomson, said that maintenance records had been kept and advice from the inspectors had been taken to remedy the defects.
