i Cheshire coroner's court has ruled that the death of a year old boy who was killed by a reversing truck at the ranee to a mill in Congleton was not an accident. Coroner oIas Rheinberg is now writing to Congleten Borough Ind to express his concerns over safety at Hightown Mill. A jury at the inquest into the death of Gerard Byrne orded a "narrative" verdict rather than ruling it was an ident or opting for an open verdict.

In 1999 driver Martin Wrigglesworth, who was ployed by HJ Lea Oakes of Crewe, was reversing his ck at the entrance to Hightown Mill. He was forced to es his truck onto the pavement to straighten up and vehicle struck Byrne, who had stopped on the pavent to tie his shoelaces.

Wrigglesworth was fined £1,000 with £50 costs for driving hout clue care and attention and was given six penalty nts on his licence (CM 9-15 Aug 20011. HJ Lea Oakes and :ociate company Oakes Millers were fined a total of 1,000 and ordered to pay £5,000 costs after they pleaded Ity to breaching health and safety rules.

The companies admitted that their health and safety iration had focused more on the usual hazards of carryout their business of making animal feed rather than king at vehicle safety.
