• by Mite Jewell A transport manager must be in a position to offer continuous and effective responsibility for the management of a transport operation. That is the blunt message to operators from the Traffic Commissioners.

This policy was made plain oy North Western Deputy Traffic Commissioner Mark Hinchliffe when he revoked the licence held by Bolton owner-driver Keith McGuinness (see page 8).

The DTC said that with the high standards required of operators in relation to maintenance and drivers' hours, the ability of the transport manager to offer 'continuous and effective responsibility' was crucial.

Licences were granted on the basis that operators had transport managers willing to meet the CPC qualification.

TCs trusted transport managers to do the job properly and not leg)triise operators falling short of the system. In the majority of cases, said Hinchliffe, the inescapable conclusion was that the transport manager should be a direct employee.

In a very small number of cases it might be possible for one transport manager to provide those services to more than one operator. However, in that case there needed to be regular face-to-face contact.

If a transport manager felt operators were in any way falling short of the required high standards, Ns duty was to take appropnate actIon even to the extent of withdrawing as a transport manager and notifying the Traffic Area Office that the relationship was not working.

The trend of agency trans port managers taking on large numbers of operators was a relationship that in many cases was likely to fail, as they would not have the hands-on involvement that was required. TCs were not saying that it was illegal to be the transport manager for more than one operator, but they needed to take great care.
