This follows MAN's purchase of ERF in 2000, which it bought from Canadian manufacturer Western Star. Some months later, DaimlerChrysler bought Western Star.
DaimlerChrysler does not believe that MAN has a case as it did not own western Star at the time of MAN's purchase.
