• South Eastern and Metropolitan LA Brigadier Michael Turner has altered conditions he had proposed for a licence granted to Congelow Produce, following representations about the effect they would have on the company's business.

The company, which had been formed to take over the business of Marie and Donald Cooper, had applied for a two-vehicle restricted licence based at Den Farm Lane, Tonbridge.

Following environmental representations from neighbouring residents at a Tonbridge public inquiry, the LA granted the licence but indicated that he proposed imposing conditions restricting the times at which the vehicles could enter and leave the operating centre.

But he said the company was entitled to make representations about the effect the proposed con ditions might have on its business.

The company asked for a change to the conditions restricting vehicle movements on Sundays and Bank Holidays. Congelow said deliveries had to be made to Safeways at between 06:00 and 11:00hrs on Sundays. And Henley Transport Company, of Paddock Wood, collected packed produce from the company and it had indicated that Congelow would occasionally have to deliver on Sundays and Bank Holidays.

Brigadier Turner said Safeways' supporting letter did not allocate a time band during which the vehicles had to be at its Aylesford depot; it simply said "ASAP". Though he saw some merit in the company's request to alter the timings, given the journey time to Aylesford he would have thought a later start was feasible.

The LA varied the conditions for Sundays and Bank Holidays to enable vehicles to enter and leave between 09:30hrs and 1500hrs, and he raised the limit on vehicle movements from one to three, up to six times a year. Each of those occasions must be notified to the traffic area office.
