AN OPERATOR'S claim that more than a year's worth of tachograph charts had been lost in the post was branded "a convenient story" by North Western Deputy Traffic Commissioner Mark Hinchliffe at a Leeds public inquiry.

The DTC allowed Swinton-based JP Freightways to surrender its licence and granted interim authority to its director Daniel Adams to carry on operating as a sole trader. But he warned that stories about tachograph charts and a big envelope were unlikely to be believed in the future.

Hinchliffe was unhappy with transport manager Angela Brough's explanation for the disappearance of 13 months' worth of tachograph charts. She had not been asked to produce that volume of charts but had said she had misread the request and had put 13 months' charts in an envelope which she posted without proof of posting and which never arrived. It seemed a convenient story. In future he would not expect the transport manager to be so cavalier about the safety of tachograph charts.

For the company, Andrew Woolfall said Freightways had been bought by Adams some time ago. Almost two years ago his accountants advised he would be better running as a sole trader.The company was made dormant and Adams started operating as a sole trader. Following advice Adams had recently submitted an application for a licence in his own name as he had been operating without licence authority.

It was conceded there had been problems over vehicle maintenance, drivers' hours and tachographs —new systems had been put in place.

The DTC was given seven undertakings in relation to vehicle maintenance, driver training and tachograph chart analysis.
