and using it at the wrong rate of vehicle excise duty has cost Northern Irish haulier Cormac Leonard and one of his drivers £2,351 at Rochdale magistrates.

The offences were admitted by Leonard, of Loghall Road, Armagh.

Prosecuting for the DOT, John Heaton said that last April a sixaxled artic driven by Michael Mallon was stopped in a check at the Tharnham Island dynamic axle weighbridge. When weighed it was found to be overloaded on the first axle by 940kg13.3% —and by 1,470kg on the train weight-3.8%.

The tax paid on the vehicle was at the recovery vehicle rate—£75.

In a letter to the court Leonard said the haulier usually engaged for the job was unable to fulfil it and his driver Mallon was sent at short notice. The vehicle was normally used as a recovery vehicle: that was why it was incorrectly taxed. The magistrates fined Leonard £900 and ordered him to pay £776.66 back duty and 1100 prosecution costs. Mallon was fined £500 and ordered to pay £75 prosecution costs.
