Which of the following most accurately describes the problem?

FOR POSSIBLY the first time ever, an operator has managed to have the conditions on which his 0 licence was granted changed, and keep his licence.

Last year, Reginald John Brookes trading as R. J. Brookes Haulage Co renewed his 0 licence on condition that he would not park his vehicles at Water Road, Dudley.

But now Mr Brookes has succeeded in applying for the removal of the condition before the West Midlands Licensing Authority.

Outlining the history of the case for Mr Brookes, Michael Carless said that since last year Mr Brookes had obtained a certificate of established use from the local planning authority for the use of Water Road for parking.

Consequently he was seeking variations of the licence condition.

West Midlands Licensing Authority, A. A. Crabtree, said the certificate of established use in itself did not alter the situation.

The Transport Tribunal had laid down that Licensing Authorities should not take into account planning issues, and it was up to him as the Licensing Authority to decide whether the site was suitable orpot.

In evidence Mr Brookes said the site consisted of a piece of land adjoining a block of garages. He had used the site for parking since 1962 without any complaints from residents.

It was his intention to use it for the parking of his rigid vehicle and tractive units. The trailers would continue to be parked at Oak Lane.

Granting the application after examining plans of the site Mr Crabtree said he felt that it was all right.
