A Lincolnshire company failed to attend a public inquiry called after denials that it had been dissolved. Market Rasen-based Rochester Import/Export had been called before North Eastern Deputy Traffic Commissioner Mark Hinchliffe.

In September the Traffic Area Office had written to it saying that the TC proposed revoking its licence for three vehicles and three trailers as it had come to his attention that it had been struck off and dissolved in June.

A reply was received signed by a Joe Patterson saying that the company had not been dissolved. However, Patterson had never been a director of the company; it appeared not to have had any directors since January 2000. Patterson had been company secretary for two periods between 1999 and 2000.

Patterson had written to say that his mother in America had been taken ill and he was unable to attend the public inquiry.

in November 1999 a vehicle examiner had reported that he was unable to contact the company, that its address had changed and that the owner of the operating centre had not seen the company for six months. A similar report was made In April 2001.

In August contact was made with the company. It was agreed that any vehicle records, including tachograph records, would be presented to the vehicle examiner on August 6, but the examiner said that a representative of the company telephoned on the day to say that the appointment could not be kept as the director concerned was unavailable and all the documentation had been stolen.

By this time the company had been struck off the register for nearly two months, said the Deputy TC.

If it remained necessary to revoke the licence, then he did so forthwith.

However, his view was simply that if there was no operator, there was no licence.
