A TRUCK DRIVER who ploughed into a stationary car, killing its driver, while he was distracted by using his mobile phone has beenjailed for four years.

Winchester Crown Court heard that John Payne, from Chesham, Bucks, was doing 47mph when his 7.5-tonner ploughed into Trinity Taylor's car on the M3 near Basingstoke last October.

Taylor suffered massive head and chest injuries and was pronounced dead at the scene. Payne's truck had rolled over the top of Taylor's car. Payne, who admitted causing death by dangerous driving, was also banned from driving for seven years. Andy Houston, prosecuting, said that minutes before the crash Payne had told his dr..ver's mate that he wanted to find out how to use the phone. which was in a cradle, and started punching numbers on the keypad.

In mitigation. Ian Lawrie said Payne was suffering depression and anxiety following the crash.

Passing sentence, Judge Michael Brodrick saidrAnyone wanting an illustration of using mobile phones in a vehicle only has to look at this case. You struck a vehicle driving a 7.5-tonne lorry because your attention was distracted.
