DUBLIN driver who neglected to use the tachograph in his lorry id was subsequently dismissed has claimed unfair dismissal at the sh Employment Appeals Tribunal.

Michael Byrne is claiming that was unfairly dismissed on :ptember 14 last from his job ; a driver with Sheffield Insula)n (Ireland) Ltd.

Giving evidence to the tribuil, the company's managing rector Don Scannell said that 1r Byrne had been involved in 1 accident near Castlerea, aunty Mayo.

Mr Scannell stressed that the ismissal was not caused by the cident but because Mr Byrne id not follow company proceure in reporting the matter and ecause he was not using the tachograph in the lorry on that occasion, with the latter reason being the main one.

The company's transport and warehouse manager, Paul Delamere, told the tribunal of a phone call from Mr Byrne on the day of the accident and later calls from Mr Scannell to find out further details.

Mr Delamere said that normally he would issue tachograph discs to the drivers, but there was a proviso that when he was not available, they should take the discs from a place in his office. The onus was on drivers to equip themselves with the charts to use in the tachographs. He agreed that failure to use the tachograph had been the fundamental reason for Mr Byrne's dismissal.

The tribunal has reserved judgment on this case.
