Which of the following most accurately describes the problem?

• Richardson's Transport (Coventry) Ltd was refused its application for an 11-ton low-loader on B licence because a prima facie had not been made out. The West Midland LA, Mr J. Else, said that he had to be sure before saying there was no case, but in this particular instance he considered that there was a lack of evidence. The application was objected, to by the NFC, Starr Roadways Ltd, Graham and Brown Transport Ltd, and the Red House Garage Co Ltd.

Mr F. Davies, for the applicant company, amended the conditions to apply to three named companies and not seven as originally listed.

The joint managing director of Richardson's Transport, Mr A. Tongue, said that he had been providing low-loader transport for some time through sub-contractors. It was not always possible to obtain this transport, however. Mr Tongue said that his company undertook the more difficult installation work with which two of the named customers Were , concerned. In respect of these two companies he was prepared to amend the application.
