Which of the following most accurately describes the problem?

Licensing Authority refusing special A licences to two Scottish hauliers for the operation of lorries from bases in the Midlands, were sent back to the Authority by the Transport Tribunal in London on Tuesday.

" I would rather have the Authority's opinion after there has been a public inquiry." said Mr. Hubert Hull, • president, after he had been told by Mr. J. R. C. Samuel-Gibbon, for both appellants, that an inquiry had not been held.

The appellants were Mr. William M. Tripney. Grangemouth. whose appeal concerned three vehicles, and Mr. John Baird (Ayrshire Transport Services), Kilmarnock, who had been refused a special A licence for one vehicle.

In Mr. Tripney's case, the three vehicleshad been bought from 'he' British Transport Commission by Mr. Samuel Anderson, of Motherwell. who had .acquired a base from the Corn

mission at Woodnorton Road, Langley, Birmingham. The three vehicles were assigned to Mr. Tripney on November 21, 1955.

Mr. Tripney applied for a special A licence for the vehicles to operate from Woodnorton Road, care of Mr. Anderson, but after some time the Licensing Authority said he was prepared to grant licences to the assignor, but not to the assignee.

Mr. Hull interposed to say there appeared to be nothing before the Tribunal to show that Mr. Tripney was the assignee. Mr. Samuel-Gibbon said he preferred to rely for proof that Mr. Tripney was the assignee on a statement to the Authority by the assignor.

Mr. Hull: "It wasn't made in these proceedings at all, was it?"

Mr. Samuel-Gibbon said there had been no formal proceedings until the case came before the Tribunal that day.
