AN OWNER driver who believed that his bankruptcy had been discharged in January 1984 was told last week that an application had been made by a creditor, to the court, to vary the order.

As a result, the hearing, before Eastern Deputy Licensing Authority Charles Arnold-Baker in Chelmsford, held under Section 69 of the 1968 Transport Act, was adjourned.

Mr T. Pheney, trading as Witham Storage, had been called following convictions concerned with using a trailer which was unfit for service.

Mr Pheney, who was formerly a traffic manager with SPD, told the court that at the time of the offence he was driving a lorry which was pulling a Dutch trailer and had been "appalled at its condition" when the police inspected it.

Mr Pheney produced maintenance schedules in court and called on a Department of Transport traffic examiner to speak in his support.

He told the court that he was now engaged solely by WBS Transport from whom he received, on average, £3,600 per month. His operator's licence is due for renewal in April this year.
