JOAN AITKEN, traffic commissioner (TC) for Scotland (pictured right), has revoked the 0-licence of a Fraserburgh haulier who was sent to prison after using a device to breach drivers' hours regulations.

At a public inquiry in July in Edinburgh, Aitken told George Davidson, 59, that he would also be disqualified from driving trucks and could not re-apply for his professional licence until his 75th birthday. At the PI, the TC heard evidence from a Vosa traffic examiner, who stopped Davidson in June 2012 in Cumbria. An examination

of his tacho records revealed 69 instances where the records had been falsified. Davidson, who had been authorised to run one vehicle and one trailer, was imprisoned for six months for the offences. A subsequent examination revealed the vehicle had been fitted with an interrupter device,

manipulating the tacho record. Davidson denied knowing about this device but admitted to using a magnet.

The TC noted that Davidson had a previous conviction and disqualification for tachograph offences, and added: "There is no evidence to support any finding that he could ever be a compliant operator."

Summing up

TC Aitken concluded that Davidson's willingness to falsify his records had shown he was a person who was capable of deceit and untruthfulness.
