Driver Nigel Rudkin has won his appeal against conviction at Chelmsford Crown Court; he had been previously been convicted on five counts of making false records.
According to a spokesman for the local Crown Prosecution Service (CPS),the court did not believe that Rudkin had "acted dishonestly" by using two tachograph charts in two separate vehicles.
The case was initially instigated by Essex Police, who declined to comment on the case.
Drivers Voice, a group of drivers and hauliers, has been following the Rudkin case. A spokesman says: "He (Rudkin), along with a huge majority of the haulage industry, was under the impression that he was doing no wrong as all he was attempting to do was record his daily duty in two vehicles using two cards.
"Essex police however, say that he has committed an offence, as he should have only used one card."
Liam Boyle, the Road Haulage Association's head of training, says: "My own view is that there is nothing wrong in using two charts. In fact, there are plenty of occasions when the use of two charts is necessary — for example, shunt drivers might drive six or eight vehicles in a day so there are practical reasons why more than one chart might be used."
