Which of the following most accurately describes the problem?

• Oldham-based haulier Brett Hampson, trading as B8,4 Hampson, has been ordered to pay £3,150 in fines and costs by Oldham magistrates after pleading guilty to drivers' hours offences.

Hampson admitted permitting drivers to exceed 41/2 hours driving without the required rest, to exceed the daily driving limit, and to take insufficient rest.

He also admitted failing to ensure drivers used tachograph charts and failing to use and preserve charts.

John Heaton, prosecuting for the North Western Traffic Area, said that when tachograph charts were analysed for the period from October to December 1990 numerous offences were revealed. Tacho charts covering a total of 28,000km were missing.

Magistrates heard that when a vehicle was double manned by Hampson and driver James Goalden they failed to record rest or other work.

For Hampson, Barrie Williams said the offences had arisen because of administrative problems resulting from the rapid expansion of the business. Hampson had since realised that he needed help and had employed an office manager.

Neither Hampson nor the drivers had gained financially from the offences. The drivers had known what they were doing, as they had admitted to bending the rules, but Hampson had not realised that a record should be kept of each driver's rest periods when vehicles were double manned.
